Juiz federal suspende temporariamente nova regra de períodos fixos de admissão para estudantes F-1, participantes de intercâmbio e representantes da imprensa estrangeira

This month, we are taking a closer look at the EB-1 visa — an employment-based green card category reserved for some of the most accomplished professionals in their fields. Below, we break down who qualifies, how the process works, and what to expect along the way.
Wondering if your professional achievements qualify you for an EB-1? Schedule a consultation with our legal experts to evaluate your profile.
What Is the EB-1 Visa?
The EB-1 is an immigrant visa category reserved for what USCIS calls “priority workers,” individuals whose skills and achievements are considered especially valuable to the United States. Unlike most other employment-based green card categories, EB-1 petitions do not require PERM labor certification, the lengthy U.S. Department of Labor process that tests whether qualified U.S. workers are available for a given position. Skipping that step makes EB-1 one of the quicker employment-based routes to a green card.

USCIS divides the EB-1 category into three subcategories, each with its own eligibility standards.
EB-1A: Extraordinary Ability
This subcategory is for people who can demonstrate extraordinary ability in the sciences, arts, education, business, or athletics, evidenced by sustained national or international acclaim. Applicants must either:
Show a single major, internationally recognized achievement (such as a Nobel Prize, Olympic medal, or comparable award), or
Meet at least three of ten specific criteria set out by USCIS. These include things like receiving nationally or internationally recognized awards, holding membership in selective professional associations, being the subject of published articles about their work, judging the work of others in the field, making original contributions of major significance, authoring scholarly articles, holding a leading role at a distinguished organization, or commanding a high salary relative to peers.
A notable feature of EB-1A is that applicants can self-petition, meaning that no job offer or employer sponsorship is required, though they must show they intend to continue working in their field of expertise.
EB-1B: Outstanding Professors and Researchers
The EB-1B is for academics who are recognized as outstanding in a specific field and have at least three years of teaching or research experience. To qualify, applicants must meet at least two of six evidentiary criteria (such as major awards, selective memberships, published material about their work, judging others’ work, original scholarly contributions, or authorship of scholarly articles). Unlike EB-1A, this category requires a job offer, typically for a tenure-track or comparable position at a university, institution of higher education, or private employer with an established research department.
EB-1C: Multinational Executives and Managers
This subcategory is for executives or managers of multinational companies who are transferring to a U.S. office. To qualify, the applicant generally must have worked abroad in a managerial or executive capacity for at least one of the preceding three years for the same employer (or an affiliate or subsidiary), and the U.S. petitioning employer must have been doing business for at least one year. As with EB-1B, a job offer and employer sponsorship are required.

How the Process Works
An employer (or, for EB-1A, the individual) files Form I-140, Immigrant Petition for Alien Worker, with USCIS. Because EB-1 does not require labor certification, cases can often move faster than other employment-based categories. That said, EB-1 visa numbers are still limited each year, so actual processing times and visa availability can vary depending on the applicant’s country of origin.
A High Bar, But Not an Impossible One
While the EB-1 category requires substantial supporting documentation, this does not place it beyond reach. Applicants who satisfy the requirements of their chosen subcategory have a genuine and well-established path to a green card, making EB-1 one of the more direct routes to permanent residency.
Many highly qualified professionals mistakenly assume this category is reserved for internationally renowned figures, only to discover, upon a closer review of their credentials and achievements, that they in fact meet the standard.
